Advice for petitions for border seizure
Community applications pursuant to Art. 5(4) Regulation (EC) No. 1383/2003 for customs action, i.e. so-called petitions for border seizure, must also be filed online at the German Central Customs Authorities even if the application for the respective Community right was filed in another Member State but extends to Germany.
The IP Department of the German Customs Authorities has issued an online form which must be used for applications for customs action under Regulation (EC) 1383/2003 (and also for applications under German law) in May 2009. Even if the application for customs action under Article 5(4) of the Regulation based on a Community right was filed in another Member State but extends to Germany, the data of this application will have to be input using the online form (this form is, however, only available in German). The German Customs Authorities will not have access to the content of an application if this data is not provided online by the Applicant. The extension of an application filed in another Member State can then also be easily made using the online system.
