bauma 2010 in Munich: Options for Advance Border Detention Prior to the Begin of the Trade Fair
From April 19 to 25, 2010, Munich is host to the 29th International Trade Fair for Construction Machinery, Building Material Machines, Mining Machines, Construction Vehicles and Construction Equipment, "bauma 2010". This is the world's largest trade fair in this field. For goods to be imported into Germany for exhibition at the bauma 2010 and suspected of infringing an IP right, German customs authorities can take action upon request even before the opening of the trade fair.
In case of a pending request for border detention, customs authorities will prepare a "risk profile" of the suspected goods within one or two working days from receipt of special information on goods suspected of infringing an IP right, such as a customs tariff number or the name of a manufacturer or export firms etc. The risk profile will be entered into the electronic ATLAS system for customs clearance. If a third party's customs declaration for certain goods to be imported matches the features of the "risk profile", the computer will alert the customs authorities, who will then inspect the goods physically. These measures may prevent goods which infringe an IP right from being exhibited at the trade fair in the first place.
