New Decision G 2/08 of the Enlarged Board of Appeal – "Dosage regime/ABBOTT RESPIRATORY"

On 19 February 2010, the Enlarged Board of Appeal of the European Patent Office issued its decision in re G 2/08 "Dosage regime/ABBOTT RESPIRATORY" und thus answered a referral on the admissibility and patentability of claims on the second (or further) medical use.

Provisional Injunctions Should Now Be Easier and Quicker to Obtain at Upcoming Trade Fairs in Hanover

The Regional Court of Braunschweig has announced that it will again be offering next year a stand-by service to hear provisional injunction cases during important trade fairs in Hanover. This Court is the only court with jurisdiction in the state of Lower Saxony for patent, utility model, design and trademark infringement cases. It is well aware from past experience that its services are in great demand at these times.

The Treaty of Lisbon Came into Effect on 1 December 2009 With a New Legislative Power for Intellectual Property Rights

The Lisbon Treaty came into effect on 1 December 2009 in the 27 Member States of the European Union, affecting about 500 million EU citizens. The Lisbon Treaty amends the Treaty on the European Union (TEU), and it also amends the Treaty Establishing the European Community that is now called the Treaty on the Functioning of the European Union or just TFEU. The two treaties, i.e. the TEU and the TFEU, have equal value and have been supplemented by protocols of equal value. Consolidated versions of the treaties have been published at www.consilium.europa.eu. German Federal Court of Justice Confirms Patentability of Escitalopram

Following the hearing on 10 September 2009, the German Federal Court of Justice (Bundesgerichtshof) confirmed in its judgment of the same day the validity of the Supplementary Protection Certificate DE 103 99 030 issued for the active ingredient escitalopram (case docket Xa ZR 130/07). Hence, the antidepressant Cipralex® of the Danish pharmaceutical company H. Lundbeck A/S will continue to enjoy protection in Germany until June 1, 2014.
