The above-mentioned authors, all attorneys-at-law or (prospective) patent attorneys of HOFFMANN EITLE, have contributed a comprehensive section on the Japanese law of patents and utility models in the newly published "Handbook on Japanese Commercial and Business Law". The Handbook has been edited by Dr. Harald Baum, head of the Japan Unit at the Max Planck Institute for Comparative and International Private Law, and Prof. Dr. Moritz Bälz, holding the chair for Japanese Law at the Goethe University Frankfurt.

The section provided by the colleagues of HOFFMANN EITLE comprehensively deals with the Japanese law of patents and utility models in all practically relevant aspects. Starting with an overview on the historical development it is composed of the following parts:

  • Requirements for Obtaining a Patent related to Substantive Law
  • Rights of the Inventor
  • Grant, Revocation, and Correction of Patents
  • Interpretation of the Technical Scope of Protection
  • The Effect of Patents (Infringing Acts)

  • Infringement Proceedings
  • Particularities of the Utility Model

Further to the above, Dr. Dernauer edited the sections on the "Law of General Terms and Conditions" and "Law on Consumer Protection".
