Amendment to the German Act against Unfair Competition (UCA) that Entered into Force on 10 December 2015

It seems that we in Germany must give up our notion that we are a model member of the EU. The reality is that for some time and in many sectors the binding regulations issued by the EU have often been implemented into our national legal system only quite late or insufficiently.

German legislators were criticized by the EU Commission for not having sufficiently implemented an EU Directive from 2005 concerning unfair business-to-consumer commercial practices. In order to avoid infringement procedures, the German legislators had to once more amend its Act against Unfair Competition and this amendment came into force on 10 December 2015.

Dr. C. Holger Folz, Attorney-at-Law and member of HOFFMANN EITLE's patent litigation and licensing team, has prepared a summary of and comments on the most important amendments to the Act against Unfair Competition.
