In the December issue of "Patents and Licensing", Dr. Joachim Renken and Dr. Joseph Taormino of HOFFMANN EITLE' biotech department report on the decision C-428/08 ("Monsanto") of the European Court of Justice, clarifying the applicability of the Biotechnology Directive 98/44/EC and the protective scope of DNA-based patent claims in the European Union. Further to a comprehensive analysis of the decision, the authors provide recommendations for the preparation and filing of patent applications for inventions related to biological material, including DNA sequences.
