In the March issue of eipr, Dr. Dirk Schüßler-Langeheine and Dr. Simon Klopschinski, members of HOFFMANN EITLE's legal department, review a judgment of the German Federal Court of Justice dated March 18, 2010, ruling that an incomplete German translation of a European patent in either French or English does not prevent the European patent from being effective in Germany. This decision has ended a series of lower instance decisions that held that European patents would be void ab initio in Germany if the German translation submitted to the German Patent and Trademark Office was incomplete.
